Welcome to Laterite Coorg. These Terms & Conditions ("Terms") govern your access to and use of the website www.lateritecoorg.com (the "Site") and the purchase of any products offered through it.
The Site is owned and operated by Laterite Coorg ("Laterite Coorg", "LATCO", "we", "us", or "our"), a business engaged in growing, roasting, and selling single-estate coffee and spices from Kodagu, Karnataka.
By accessing, browsing, registering on, or placing an order through the Site, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, each of which is incorporated by reference.
If you do not agree with these Terms, please do not use the Site or place an order.
These Terms constitute an electronic record under the Information Technology Act, 2000 and do not require any physical or digital signature.
In these Terms, unless the context requires otherwise:
"Account" means a registered user account on the Site.
"Customer", "you", "your" means any person who accesses the Site or places an order.
"Order" means a request submitted by you to purchase products through the Site.
"Products" means the coffee, spices, and related goods offered for sale on the Site.
"Subscription" means a recurring order placed under our "Subscribe & Save" programme.
"Content" means all text, images, graphics, logos, designs, and other material on the Site.
By using the Site, you represent and warrant that:
you are at least 18 years of age and capable of entering into a legally binding contract under the Indian Contract Act, 1872;
if you are using the Site on behalf of a business or other entity, you have the authority to bind that entity to these Terms; and
the information you provide is true, accurate, current, and complete.
We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion, including where we reasonably believe these Terms have been breached.
To access certain features (such as saved addresses, order history, and subscriptions), you may need to create an Account.
You agree to:
provide accurate and complete registration information;
keep your login credentials confidential and secure;
accept responsibility for all activity that occurs under your Account; and
notify us immediately of any unauthorised use of your Account.
We are not liable for any loss arising from unauthorised use of your Account resulting from your failure to safeguard your credentials. We may suspend or terminate your Account if we suspect misuse, fraud, or a breach of these Terms.
We make every effort to describe our Products — including roast levels, weights, origin, and pricing — as accurately as possible. However, we do not warrant that Product descriptions, images, colours, or other content are entirely error-free.
As our Products are natural agricultural goods, slight variations in appearance, aroma, flavour, grind, and colour between batches are normal and are not defects.
Product images are for illustration. Packaging, labelling, and presentation may vary.
All Products are subject to availability. We may limit quantities, discontinue Products, or modify offerings at any time without notice.
We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.
All prices are listed in Indian Rupees (₹/INR) and are inclusive of applicable taxes unless stated otherwise.
Prices are subject to change without notice, but changes will not affect Orders we have already accepted.
Shipping charges, where applicable, are shown at checkout and are governed by our Shipping Policy.
We accept payments via UPI, credit/debit cards (Visa, Mastercard), and net banking, processed securely through our third-party payment gateway (Razorpay). By making a payment, you agree to the payment gateway's terms as well.
We do not store your full card, UPI, or net-banking credentials. Payment information is handled directly by the payment gateway.
In the event of a pricing error, we reserve the right to cancel the affected Order and refund any amount paid, even after an Order confirmation has been issued.
Placing an Order constitutes an offer by you to purchase Products under these Terms.
An automated Order confirmation (by email, SMS, or on-screen) acknowledges receipt of your Order but does not constitute acceptance.
A binding contract is formed only when we dispatch the Products or expressly confirm acceptance of your Order.
We reserve the right to accept or reject any Order, in whole or in part, for reasons including but not limited to Product unavailability, errors in pricing or Product information, suspected fraud, or delivery limitations. If we cancel an Order after payment, we will refund the amount paid for the cancelled items.
If you enrol in our Subscription programme:
you authorise us (and our payment gateway) to charge your chosen payment method on a recurring basis according to the frequency you select (for example, weekly, fortnightly, or monthly);
applicable Subscription discounts (up to the advertised percentage) apply only while the Subscription remains active;
you may pause, modify, skip, or cancel your Subscription at any time through your Account or by contacting us, subject to any cut-off time before the next dispatch;
price changes to Subscription Products will be notified to you in advance and will apply to subsequent deliveries;
we may cancel or suspend a Subscription if payment fails, a Product is discontinued, or these Terms are breached.
You are responsible for cancelling or modifying a Subscription before the next billing/dispatch cycle to avoid being charged for that cycle.
We currently ship within India through third-party logistics partners (including Shiprocket and its courier network).
Delivery timelines are estimates and are not guaranteed. Delays may occur due to courier operations, weather, remote locations, public holidays, or events beyond our control.
Risk of loss and title for Products pass to you upon delivery to the address you provide.
It is your responsibility to provide a complete and accurate delivery address. We are not liable for failed or delayed deliveries caused by incorrect address details or the recipient's unavailability.

Our Products are food items intended for human consumption and are manufactured and sold under FSSAI Licence No. 21226188002611.
Please check the packaging for the "best before" / "use by" date, storage instructions, and ingredient information upon receipt.
Store Products as directed (for example, in a cool, dry place, away from direct sunlight and moisture) to preserve freshness and quality.
If you have any food allergies or sensitivities, please review Product information carefully before consuming. We are not liable for reactions arising from ingredients that are disclosed on the Product or its packaging.
Because our Products are perishable and consumable, returns are subject to special conditions set out in our Returns & Refunds Policy.
Returns, refunds, replacements, and cancellations are governed by our Returns & Refunds Policy, which forms part of these Terms.
In summary, because our Products are perishable food items:
returns are generally accepted only where a Product is damaged, defective, spoiled, or incorrect on arrival;
claims must be raised within the timeframe specified in the Returns Policy, with supporting evidence such as photographs;
we may, at our discretion, offer a replacement, store credit, or refund; and
refunds, where approved, are processed to the original payment method within the timeframe stated in the Returns Policy.
Wholesale, bulk, and business-to-business ("B2B") orders may be subject to separate terms, minimum order quantities, pricing, and payment arrangements agreed in writing.
Nothing on the Site constitutes a binding wholesale offer. Wholesale enquiries submitted through the Site are invitations to discuss and do not create a contract until confirmed by us in writing.
Promotional offers, discount codes, and coupons are subject to their own specific terms, validity periods, and eligibility conditions.
Unless stated otherwise, offers cannot be combined, have no cash value, and are non-transferable.
We reserve the right to modify, suspend, or withdraw any promotion at any time, and to cancel Orders where a coupon or promotion has been used fraudulently or in breach of its terms.
You agree not to:
use the Site for any unlawful, fraudulent, or unauthorised purpose;
interfere with or disrupt the Site, its servers, or networks;
attempt to gain unauthorised access to any part of the Site, accounts, or systems;
use bots, scrapers, or automated means to access or collect data from the Site without our permission;
transmit any viruses, malware, or harmful code;
impersonate any person or entity or misrepresent your affiliation; or
infringe our intellectual property or the rights of others.
We reserve the right to investigate and take appropriate action, including suspending access and reporting to authorities, against anyone who violates this section.
All Content on the Site — including the "Laterite Coorg" and "LATCO" names, logos, trademarks, text, graphics, photographs, product designs, and layout — is owned by or licensed to us and is protected under applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes.
You may not copy, reproduce, distribute, modify, publish, or create derivative works from any Content without our prior written consent.
Any unauthorised use terminates the licence granted above.
If you submit reviews, ratings, comments, photographs, or other content ("User Content"), you grant us a non-exclusive, royalty-free, worldwide, perpetual licence to use, reproduce, display, and distribute that User Content in connection with our business and marketing.
You represent that your User Content is accurate, is your own or that you have the right to submit it, and does not infringe any third-party rights or violate any law.
We reserve the right to review, edit, or remove any User Content at our discretion, including content that is unlawful, offensive, misleading, or otherwise objectionable.
The Site may contain links to third-party websites, platforms, or services (such as our Instagram, WhatsApp, payment gateway, or logistics partners).
These are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of any third party.
Your use of third-party services is at your own risk and subject to their terms.
The Site and Products are provided on an "as is" and "as available" basis.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except for warranties that cannot be excluded under applicable law (including your statutory rights under the Consumer Protection Act, 2019).
We do not warrant that the Site will be uninterrupted, secure, or error-free, or that defects will be corrected.
To the maximum extent permitted by applicable law:
we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or Products;
our total aggregate liability arising out of or relating to any Order shall not exceed the amount actually paid by you for that Order; and
nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our proven negligence, or your statutory consumer rights.
You agree to indemnify, defend, and hold harmless Laterite Coorg, its owners, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected with:
your breach of these Terms;
your misuse of the Site;
your violation of any law or the rights of any third party; or
any User Content you submit.
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, extreme weather, crop failure, epidemics or pandemics, strikes, transport or courier disruptions, failures of utilities or telecommunications, government actions, or civil unrest.
Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Site, you consent to our data practices as described in the Privacy Policy.
We may suspend, restrict, or terminate your access to the Site or your Account at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law, or to protect our Site, customers, or business.
You may stop using the Site and close your Account at any time.
Termination does not affect any rights, obligations, or liabilities that accrued before termination, and provisions which by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) shall continue to apply.
These Terms and any dispute arising out of or in connection with them or the Site shall be governed by and construed in accordance with the laws of India. Subject to Section 25, the courts at Bengaluru, Karnataka shall have exclusive jurisdiction.
In the event of any dispute, we encourage you to first contact us so that we may attempt to resolve the matter amicably.
Consumer complaints are handled in accordance with the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

We will acknowledge complaints within forty-eight (48) hours and endeavour to resolve them within the timeframe prescribed under applicable law.
We may revise these Terms from time to time to reflect changes in our business, technology, or legal requirements. The updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Site after any changes take effect constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.
Entire agreement: These Terms, together with the policies incorporated by reference, constitute the entire agreement between you and us regarding the Site and supersede any prior agreements.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our consent. We may assign our rights and obligations without restriction.
